2. Scope and Other Policies
These Terms govern the sale of musical instruments, accessories, replacement parts, and other physical products ("Products") through the Site for delivery within the United States. They do not govern wholesale, dealer, distributor, or resale transactions, which may be subject to separate written terms.
Our Privacy Policy explains how we handle personal information. Our Shipping Policy and Returns Policy provide additional operational details and are incorporated into these Terms. If a specific Product page or written promotion contains terms that conflict with these Terms, the more specific terms control only for that Product or promotion. Nothing in these Terms limits any right or remedy that cannot lawfully be limited.
3. Eligibility and Account Information
You must be at least 18 years old and legally capable of entering into a contract to place an order. If a Product is intended for a child, the order must be placed by an adult.
You agree to provide current, complete, and accurate billing, shipping, and contact information. You are responsible for activity under your account and for keeping any password confidential. We may refuse, limit, or cancel an order where we reasonably suspect fraud, unauthorized use, a pricing or inventory error, a violation of these Terms, or an order intended for unauthorized resale or export.
4. Product Information and Safe Use
We try to describe and display Products accurately. Colors and appearance may vary because of screen settings, manufacturing tolerances, and reasonable product changes. Images may show accessories that are not included. Product measurements and weights are approximate unless stated otherwise.
Musical instruments must be assembled, maintained, cleaned, and used in accordance with the instructions supplied with the Product. Children must use Products under appropriate adult supervision. Do not use a damaged Product, place loose parts in the mouth, modify a Product, or use it for a purpose for which it was not designed. Mouthpieces and other parts that contact the mouth should not be shared unless properly cleaned and disinfected. Product descriptions and educational materials are general information and are not medical, therapeutic, or professional advice.
5. Orders and Contract Formation
Your order is an offer to buy the Products in your cart. An automated order acknowledgement confirms receipt but does not mean that we have accepted the order. We accept an order when we send a shipment confirmation or otherwise expressly confirm acceptance. We may reject or cancel an order before acceptance.
If we cancel an order after payment has been authorized or collected, we will release the authorization or refund the amount charged for the cancelled item. Products are subject to availability. We may limit quantities per person, household, account, payment method, or order.
6. Prices, Taxes, Promotions, and Payment
Prices are shown in U.S. dollars and may change without notice before an order is placed. The price charged is the price displayed at checkout, subject to correction of obvious errors. Applicable shipping charges and taxes will be shown at or before checkout.
You authorize us and our payment processors to charge the payment method you provide for the order total. You represent that you are authorized to use that payment method. Promotional codes have no cash value, cannot be combined unless stated, and may be withdrawn or corrected where permitted by law. If a pricing or promotion error is discovered, we may cancel the affected order and provide a refund.
7. Shipping, Delivery, Title, and Risk of Loss
We ship only to destinations shown as available at checkout. Shipping and delivery dates are estimates unless expressly stated as guaranteed. We will comply with applicable law if a shipment is delayed, including by seeking consent to a delay or providing a cancellation and refund option when required.
Title to and risk of loss for a Product pass to you when the Product is delivered to the shipping address you provided. You are responsible for ensuring that the shipping address is accurate and secure. We are not responsible for a delivery delay or loss caused by an incorrect address supplied by you, but we will reasonably assist with a carrier inquiry.
Inspect the shipment promptly. If a package arrives visibly damaged, or an item is missing, damaged, or not what you ordered, contact Customer Support as soon as reasonably possible and retain the packaging while we investigate. Your statutory rights are not affected by any requested notification period.
8. Returns, Exchanges, and Refunds
Returns and exchanges are governed by the Returns Policy displayed on the Site at the time of purchase: [INSERT DIRECT URL TO U.S. RETURNS POLICY]. The Returns Policy must state the applicable return period, the required condition of returned Products, any hygiene restrictions, any return-shipping responsibility, and any permitted restocking charge before an order is placed.
A voluntary return policy does not limit rights that apply to defective, damaged, misdescribed, or incorrectly supplied Products. Refunds will be issued to the original payment method unless applicable law requires otherwise. Original or return shipping charges are refundable only when stated in the Returns Policy or required by law.
9. Resale and Export Restrictions
Products offered through the consumer checkout are sold for personal, family, household, classroom, or other end use, and not for commercial resale. You may not purchase Products for unauthorized resale or export, circumvent quantity limits, or use the Site or Products in violation of U.S. export controls, sanctions, or other applicable law.
10. Intellectual Property and Site Use
The Site and its text, photographs, graphics, videos, product names, logos, designs, downloads, and other content are owned by or licensed to Warwick and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for lawful personal or internal educational purposes.
You may not copy, scrape, republish, sell, reverse engineer, interfere with, or exploit the Site or its content except as permitted by law or with our written consent. pBone, pTrumpet, pBuzz, pCornet, pBone mini, Warwick Music, and associated logos and product get-up are trademarks or trade dress of Warwick or its affiliates. No license is granted except as expressly stated.
11. Third-Party Services and Links
The Site may use or link to services provided by third parties, including payment processors, carriers, social networks, and embedded media providers. Their services may be governed by separate terms and privacy notices. We are not responsible for third-party sites or services that we do not control, but this does not limit our responsibility for our own obligations or for service providers where the law makes us responsible.
12. Site Availability and Website Disclaimer
We may update, suspend, or discontinue Site features. We do not promise that the Site will always be available, uninterrupted, secure, or error-free. To the fullest extent permitted by law, the Site and general Site content are provided "as is" and "as available."
This Section applies to the Site and general informational content. It does not override the product warranty in Schedule 1, any express Product description that forms part of your purchase, or any warranty or consumer right that cannot lawfully be excluded.
13. Limitation of Liability
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS THE TYPES AND AMOUNTS OF DAMAGES THAT MAY BE RECOVERED, TO THE FULLEST EXTENT PERMITTED BY LAW.
To the fullest extent permitted by applicable law:
- Warwick and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, business opportunity, goodwill, or data, arising from or relating to the Site, an order, or a Product, even if advised that such damages were possible.
- Warwick's total aggregate liability arising from or relating to a Product or order will not exceed the amount you paid to Warwick for the Product giving rise to the claim.
- The limitations apply regardless of the form of action, whether in contract, warranty, tort (including negligence), strict liability, statute, or otherwise, and even if a limited remedy fails of its essential purpose.
These limitations do not exclude or limit liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury to the extent caused by a matter for which liability cannot lawfully be limited, or any product-liability, warranty, consumer-protection, or other right or remedy that applicable law does not permit us to exclude or limit.
Some states do not allow certain exclusions or limitations of liability. In those states, the exclusions and limitations above apply only to the maximum extent permitted by law.
14. Your Responsibility for Misuse
To the extent permitted by law, you are responsible for losses and claims arising from your unlawful use of the Site, your material breach of these Terms, or your intentional misuse or unauthorized modification of a Product. This Section does not require you to indemnify Warwick for Warwick's own negligence, product defect, breach of warranty, or violation of law.
15. Events Beyond Reasonable Control
We are not liable for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, fire, epidemic, war, terrorism, civil disorder, labor disputes, transportation or carrier disruption, utility or communications failure, cyberattack, government action, embargo, or shortage of materials. This Section does not excuse payment obligations already due and does not limit any cancellation, delay-notice, or refund right provided by applicable law.
16. Governing Law and Disputes
These Terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that the mandatory consumer-protection laws of your state of residence will apply to the extent they cannot lawfully be waived.
Before filing a lawsuit, you and Warwick agree to make a good-faith effort for at least 30 days to resolve the dispute informally. Send a written description of the issue and the relief requested to the contact details in Section 1. This informal process does not prevent either party from seeking urgent injunctive relief and does not extend a legal limitation period unless the law provides otherwise.
Subject to any right you have to bring a claim in small claims court or in another forum required by applicable law, the state and federal courts located in Delaware will have non-exclusive jurisdiction. Nothing in this Section deprives a consumer of the protection of a law or forum that cannot validly be waived.
17. Changes to These Terms
We may revise these Terms from time to time. The version posted when you place an order will govern that order unless a change is required by law. We will post the updated effective date. Changes will not retroactively reduce warranty coverage for a Product already purchased.
18. General Terms
If a provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent, except where applicable law permits. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the Site or business, provided that this does not reduce your non-waivable rights.
These Terms, the applicable order confirmation, the Product description, the Returns Policy, the Shipping Policy, the Privacy Policy, and Schedule 1 form the entire agreement for your purchase, subject to any additional rights created by law. Headings are for convenience only. "Including" means "including without limitation."

This Limited Warranty applies to qualifying Warwick Music Inc. Products purchased through the U.S. checkout at pbonemusic.com. Keep your proof of purchase.

IMPORTANT LIMITATIONS: TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO 12 MONTHS FROM THE DATE OF ORIGINAL RETAIL PURCHASE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU. TO THE EXTENT PERMITTED BY LAW, WARWICK WILL NOT BE LIABLE UNDER THIS LIMITED WARRANTY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. B. Who Is Covered
This Limited Warranty covers the original consumer purchaser and, if the Product was purchased as a gift, the initial gift recipient. It is not transferable to a later owner. Products purchased for resale are not covered. Separate written terms may apply to dealer, distributor, rental-fleet, or other commercial purchases.
C. Products and Parts Covered
This Limited Warranty covers new Warwick or pBone Music branded musical instruments and branded accessories purchased directly through the U.S. checkout at pbonemusic.com. It covers defects in materials or workmanship that arise under normal use during the warranty period.
D. Warranty Period
Coverage begins on the date of original retail purchase and lasts for 12 months. A repaired or replacement Product is covered for the remainder of the original 12-month period or 90 days from the date it is returned to you, whichever is longer, unless applicable law requires a longer period.
E. What Is Not Covered
This Limited Warranty does not cover:
- normal wear and tear, including cosmetic scratching, scuffing, fading, discoloration, or finish wear that does not affect function;
- routine maintenance, cleaning, lubrication, adjustment, or replacement of consumable or wear parts through ordinary use;
- damage caused by accident, impact, crushing, improper storage, exposure to excessive heat or cold, liquids, chemicals, or other external causes;
- damage caused by misuse, neglect, improper assembly, improper cleaning, failure to follow supplied instructions, or use other than the Product's intended musical or educational purpose;
- damage caused by unauthorized modification, incompatible parts, or repair by a person not acting for Warwick, except that the use of third-party parts or services does not by itself void coverage; coverage may be denied only to the extent the third-party part, service, or modification caused the claimed problem;
- loss or theft;
- Products with a removed, altered, or unreadable serial or identifying number, where that prevents reasonable verification of coverage; or
- Products identified and sold as used, sample, clearance due to a disclosed defect, or "as is," to the extent permitted by law.
This Limited Warranty does not cover a problem that does not result from a defect in materials or workmanship. It does not limit rights you may have against a seller for a Product that arrived damaged, was not as ordered, or was misdescribed.
F. What Warwick Will Do
If a covered defect is confirmed during the warranty period, Warwick will, at its option and without charge for parts or labor:
- repair the Product;
- replace it with the same model or a functionally equivalent Product, which may be new or professionally refurbished; or
- if repair or replacement is not commercially practicable or cannot be completed within a reasonable time, refund the original purchase price for the defective Product.
These are the remedies provided by this Limited Warranty. Replacement Products or parts become Warwick's property when returned or replaced. Warwick will pay reasonable shipping costs for an approved warranty claim within the United States using Warwick's designated shipping method. Warwick is not responsible for unauthorized expedited shipping, removal or installation costs, loss of use, or a temporary replacement instrument, except where required by law.
G. How to Obtain Warranty Service
- Stop using the Product if continued use may cause injury or further damage.
- Contact Warwick Customer Support at support@pbonemusic.com or https://pbonemusic.com/pages/contact-support during the warranty period.
- Provide your name, contact information, order number or other proof of purchase, Product model, and a description of the problem. We may reasonably request photographs or video to help diagnose the issue.
- Follow the troubleshooting or return instructions we provide. Do not send a Product until you receive return authorization and shipping instructions.
- If a return is required for an approved U.S. warranty claim, use the prepaid label or other shipping method supplied by Warwick and package the Product reasonably securely. Remove personal items that were not supplied with the Product.
We may inspect the Product to confirm coverage. Warranty registration is encouraged but is not required for coverage. No dealer, reseller, employee, or agent may change this Limited Warranty unless an authorized Warwick officer agrees in writing.
H. Implied Warranties and Other Rights
This is a "limited warranty" for purposes of the Magnuson-Moss Warranty Act.
To the extent permitted by law, any implied warranty of merchantability or fitness for a particular purpose is limited to the 12-month duration of this Limited Warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
No oral or written representation creates a warranty beyond this Limited Warranty unless it is an express Product description or written commitment that applicable law treats as part of the bargain.
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
I. Limitation of Remedies and Damages
To the extent permitted by law, repair, replacement, or refund as described above is your exclusive remedy for breach of this Limited Warranty. Warwick is not liable under this Limited Warranty for incidental or consequential damages, including loss of use, rental cost, lost income, or damage to other property.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. No limitation in this Limited Warranty applies to personal injury, fraud, gross negligence, willful misconduct, product liability, or any other liability or remedy that cannot lawfully be excluded or limited.
